Topics civil law attorneys

The civil general section provides expert and specialist assistance in a variety of matters, such as the establishment of liability, the enforcement or termination of contracts, neighbourhood law issues and the drafting of contracts and general terms and conditions.

By the lawyers in the civil law section, topics covered include:

  • Purchase agreement of movable property: in the agreement of purchase and sale, problems can arise in several areas. For instance, you may get stuck in drafting such an agreement or wonder whether a purchase agreement has been reached and whether you can still withdraw your offer and abandon the purchase. In addition, you may also have questions about certain conditions that are not entirely clear to you.
  • Consumer law: as a consumer, you are considered an economically weaker and legally less experienced contracting party, which in many cases protects you from the entrepreneur who is more knowledgeable about his product and more experienced in contracting. Most of the rules concerning consumer-business contracts are mandatory law; they cannot be deviated from to the detriment of the consumer. This is in contrast to contract law in general, which has the character of supplementary, regulatory law. However, disputes may arise over the qualifications of ‘consumer’, ‘consumer purchase’, the consumer’s duty to complain and whether the delivered item is non-conforming or not. It is therefore wise to consult an attorney.
  • Liability in respect of any damage: have you suffered damage from another individual or company? This damage may have to be compensated by the party causing the damage. In that case, it should be assessed whether the perpetrator can be held liable and whether there is damage. If there are damages, the extent of your losses should be accurately determined.
  • Neighbour law (easement, nuisance): a variety of conflicts can arise in neighbour law. This could include disputes about (the extent of) an easement such as, for example, a right of way, the (location of the) property boundary, shared objects or ditches, overhanging branches or other forms of (unlawful) nuisance.
